À propos de ce document

When is it used?

Before terminating an employee with job security for conduct or performance, the employee's defence against the allegations must be taken. Termination without a defence may be found invalid.

Points to watch

  • Describe the incident, its date and the allegation specifically; avoid general statements.
  • Give a reasonable time to respond (in practice usually at least 2 business days).
  • Document delivery of the letter by signature or minutes.
  • If no defence is given, record this in minutes.
  • For immediate termination for just cause (Labour Law art. 25/II), the right must be used within 6 business days of learning of the act.

Legal basis

Labour Law No. 4857 arts. 18, 19 and 25. Related page: Termination and job security
