When is it used?

When an employee wants to end the contract of their own will. Resignation should be in writing and its delivery to the employer documented.

Points to watch

  • On resignation there is in principle no severance and no unemployment benefit. If there is just cause, such as unpaid wages or mobbing, this is termination for just cause rather than resignation, with different consequences: Resignation and just cause

  • Get a signed acknowledgement on a copy, or send it by a provable route such as a notary, registered e-mail (KEP) or registered post.
